	TERMS And CONDITIONS The balance of the purchase price is payable at installation of the product. The Customer acknowledges that the Installer is a sub-contractor for HiddenBed New Zealand (the “Supplier”) who is the Supplier of the product, and that no representation given by the Installer to the Customer is binding on the Supplier unless the Supplier itself has specifically acknowledged in writing that it is bound by the Installer’s representation. Where the Customer is acquiring the product for purposes of a business the Customer acknowledges that the provisions of the Consumer Guarantees Act 1993 (the “Act”) are hereby excluded to the fullest extent possible pursuant to the provisions of Section 43 (2) of the Act. In any event the obligations of the Supplier are to be limited to those of the Act or of any other legislative requirement, but that otherwise the Supplier is not liable to the Customer and, in particular but not limited to, shall not be liable in any way whatsoever for any consequential loss or damage. The Customer acknowledges and confirms that it will use the product in accordance with the manufacturer’s and Supplier’s recommendations as set out in the operating/installation instructions provided by the Supplier. Any rights and remedies available to the Customer are not assignable or transferrable to any other party except to the extent required by law. The Customer confirms that the property or title of the goods shall not pass to the Customer until the Customer has paid and honoured in full the purchase price. Until payment in full the Customer grants to the Supplier a Security Interest in the product and acknowledges and agrees that such interest may (at the Supplier’s discretion) be registered as a charge under the provisions of the Personal Property Securities Act 1999 (“PPSA”). Failure to pay or honour the purchase price in full shall entitle the Supplier to retake possession of the good(s)/product(s). The Customer hereby waives their right to receive verification statements connected with any financing statement or financing charge statement registered under the PPSA in relation to the security interest granted herein. The Customer hereby confirms that these provisions were made known at or before the time the product was installed.
